I just heard on Fox News that a Judge in New York has determined that the Federal Death Penalty is Unconstitutional. In other news, the world is mad at the US for not signing onto a World Court (again) which would have the power to put so-called human right violators on trial.

The world court's a rather snazzy thing, and it's a terrible shame that we've not signed into it. We bully the smaller countries into the world organizations, but then we enjoy special status in all of them, due to being the Last Superpower.
That's really not cool. When elected, I plan on rectifying this. America should be the *first* to sign on to this sort of thng. With great power comes great responsibility, donchaknow.
You know, there was a time, not so long ago, when America was hailed as the hero of the world. It wasn't that we could do no wrong, but that other countries wanted to be like us. We were a source of inspiration, as well as an example to follow. They willingly, of their own free will, cast off their old ways, in order to reflect us.
These days? I'd rather not talk about it.

No, its not snazzy and I've glad we have not signed onto it. The US Constitution is supposed to be the supreme law of the land, but to hand ultimate Judicial authority over to an external court both subverts the constitution and opens the US to have its affairs dictated by officials not elected by the people.

The problem with the World Court is all those judges from 3rd world dictatorships and communist coutries trying to tell American defendants all about what is right and what is wrong.
Do you want to be judged by a judge from China? If the party don't like his verdict, they'll kill him and his family too. I think he'll wind finding just about any American defendant guilty.
How can anyone expect justice from a judge whose country is a dictatorship? Which is to say something like 2 countries out of 3 should not have a judge on this World Court.
For all its problems, we still have have what may very well the best and fairest system of justice on the planet. For what reason should we now turn around and kiss some foreigner's rear end and humor them by saying that their way is better than our way?
I can see a world court delivering justice to criminals in coutries whose courts and police are hopelessly corrupted (Mexico, any place in Africa) or overrun with bloodthirsty powermongers (China, North Korea, Somalia, Bosnia), they need it because they don't already have it. But we do already have it and do not need outsiders trying to tell us to hand it over into their control.

The same people who want American soldiers to be judged by a UN court whose members are in no way answerable to or selected by America. These are the same people who recently elected Syria to the UN security council.
In case you don't know, Syria is pretty much on the top 5 list of governments who actively support terrorism aimed at US. And now they can cast a vote against us the next time we need to go into a country to hunt those same terrorists they give money, weapons, and training to.

I can understand the motives of the US not joinin the International Court, but it has more to do with practical considerations than any fuzzy legal argument.
The Int Court is a good thing, and the US probably should sign in, that it does not is because the fear of frivolous accusations. It would be too easy to say, accuse the US of war crimes because they bombed Serbia. It's a fallacy, and charges wouldn't hold but it would be too much a hindrance.
On the other hand, considering the CIA record in Central and South America, portions of the US Gov would have a lot to fear from the Court.
*shrugs* It's not an easy decision, I think the Court is a step in the right direction, but it's still an inmature idea.

| Considering that in different places there are different moral standards I will be surprised if it manages to keep working. The US would probably just impose its motives on others have so much political power.

It`s not like the ICC is meant for prosecuting someone who`s already been investigated in his home country, is it? Even if the investigations turned up with no proof of any war crimes, the forms have been met. You`re not going to see any Chinese, Russians or Americans there. Nor Belgians, French or Italians.
It`s only meant for sweping up the pieces in situations where the "international community" feels guilty for mishandling a conflict or reacting too slow to help.

I have seen it said on the news channels that the govts of europe have said more than once that this court is their way to give the US orders.
They want to tell us how, when, and where to use US forces and since our President feels no obligation to do what they tell him, and since the State Dept. won't obey Europe's wishes either, they have turned to pushing this farce of a court.
If we are dumb enough to say this court has authority over Americans, it will just be a matter of time before some US soldier in an airport gets grabbed and tried by a court composed of Palestinians, Chinese communists, and somebody from France. None of whom had to pass any scrutiny or background checks from us before being handed their power and authority.
We already have a system of military justice that works at the very least just as good as anyone elses. We have no reason at all to say otherwise.
Did you know that when France joined this thing, they also exempted their own soldiers from it for 10 years? France has always been the big mover behind all this one govt in europe stuff and France is not America's friend.
France is the country that tried to sell nuclear power to Saddam Hussein and North Korea. And they want to pass jugement on America? I don't think so.
